Terms & Conditions

These terms

Cairn is an employee engagement and retention survey platform operated by CAIRNHR, a limited liability company based in Park City, Utah, United States (“we”, “us”). By using Cairn you agree to these terms. If you are agreeing on behalf of an organisation, you confirm you have authority to do so.

The service

Cairn lets an employer, or an HR consultant acting for an employer, send surveys to that employer's staff and read summarised results. We provide the platform; the employer decides who is surveyed, what is asked, and what is done with the results.

Your responsibilities as a customer

  • You are responsible for the accuracy of the contact details you enter, and for having the right to contact the people you enter.
  • Before sending surveys by text message, you must have each recipient's consent to be contacted that way, and you must be able to evidence it. Cairn will not send a text to anyone without a consent recorded against them.
  • You must not use Cairn to send marketing, promotional, or unlawful content, or to contact anyone who has asked you to stop.
  • You are responsible for keeping your account credentials secure.

SMS Terms

Programme description. CAIRNHR sends employee survey invitations by text message on behalf of employers. Each message contains a link to an anonymous survey. This is not a marketing programme and we do not send promotional messages.

Consent. You will only receive these messages if your employer has recorded your agreement to be contacted by text. Consent is not a condition of employment or of purchasing anything.

Message frequency. Varies by employer. Typically a small number of messages per survey, with occasional reminders.

Cost. Message and data rates may apply. We do not charge recipients for these messages; your mobile carrier may.

Opting out. Reply STOP to any message to stop receiving them. The request is recorded immediately and that number will not be texted again.

Help. Reply HELP for information about who is messaging you and how to opt out, or email cairnhr@gmail.com.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier and device.

How we handle the information behind these messages is described in our Privacy Policy.

Anonymity of responses

Survey responses are collected anonymously and stored without a link to the person who submitted them. Results are reported in aggregate, and a group must contain at least five responses before it is reported separately. Customers must not attempt to identify individual respondents, or use Cairn results to take action against an identified individual.

Fees

Paid plans are billed as agreed with us in writing. Fees are exclusive of taxes unless stated otherwise. Where an account is provided free of charge, we may change or end that arrangement with reasonable notice.

Your data

You keep ownership of the information you put into Cairn. You grant us the rights needed to host and process it in order to provide the service. We handle personal information as described in our Privacy Policy.

Aggregated and AI use. You grant us a perpetual, non-exclusive right to create aggregated and de-identified data from survey responses and engagement data held in your account, and to use it to operate and improve the service — improving and training our analysis and models, developing features, and researching workplace engagement and retention trends — including after this agreement ends.

Two limits on that right, which we will not change without your agreement:

Your methodology stays yours. The grant above does not reach your methodology library, your consultants' edits, ratings and overrides, or the voice fingerprint built from them. That content is scoped to your firm, is never pooled with another firm's, and is never used to train a model that serves anyone but you.

Cross-firm benchmarks are opt-in.We will not include your data in a benchmark drawn across firms unless you have asked us to. Those benchmarks use aggregate outcome metrics only — never the content of anything your consultants or their clients' employees wrote. Benchmarking across your own client organisations is part of the service and needs no separate opt-in.

Everything above is also bounded: aggregated data is stripped of everything that identifies a person or an organisation, it cannot be reversed, and we will never disclose personal information, individual survey responses, or data identifying you or your clients through it. We do not sell personal information or share it with third parties for their own purposes. Nothing produced from aggregated data — no model, benchmark, or report — will identify you, your client organisations, or any individual respondent.

Availability and disclaimers

We aim to keep Cairn available and accurate but provide it “as is”, without warranties of any kind to the extent permitted by law. Automated analysis of written comments is a summarisation aid and may contain errors; it is not professional advice and should not be the sole basis for an employment decision.

Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential loss, or for lost profits or data. Our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the claim.

Ending the agreement

You may stop using Cairn at any time. We may suspend or end access where these terms are breached, where use puts the platform or other customers at risk, or where required by law. On termination we will delete or return your data on request, subject to the retention described in the Privacy Policy.

Changes

We may update these terms. Material changes will be reflected in the date at the top of this page, and continued use after a change means you accept it.

Governing law and contact

These terms are governed by the laws of the State of Utah, United States. Questions can be sent to cairnhr@gmail.com.
